Judge dismisses lawsuit challenging new Arizona immigration law
PHOENIX (AP) - A federal judge threw out a lawsuit that challenged a new Arizona law that prohibits businesses from knowingly hiring illegal immigrants, clearing the way for the restrictions to take effect in January......
PHOENIX (AP) — A federal judge has thrown out a lawsuit seeking to block a new Arizona law that prohibits people from hiring illegal immigrants and requires businesses to verify whether applicants are eligible for employment.
The law takes effect Jan. 1.
In his ruling on Friday, U.S. District Judge Neil V. Wake wrote that the lawsuit was premature because there was no evidence that anybody had been harmed, and that the plaintiffs — a coalition of business and immigrant rights groups — were suing the wrong people.
The ruling said the law gives only investigatory authority to the governor and state attorney general, who were named as defendants. Wake said county prosecutors, who weren't defendants, actually have the power to enforce the law.
The plaintiffs had asked for a preliminary injunction blocking the law from taking effect.
Julie Pace, an attorney for the business groups, said her clients were meeting Saturday to determine whether to appeal the ruling or file a separate lawsuit against the county prosecutors. She said the business groups could pursue both avenues.
Alfredo Gutierrez, a spokesman for immigrant rights groups, said they plan to refile the lawsuit after Jan. 1, when they might be able to show damages caused by the law.
A spokesman for Gov. Janet Napolitano said the governor's office had not yet read the ruling and had no immediate comment.
Napolitano signed the bill in July, saying that while immigration is a federal responsibility, Congress was apparently "incapable of coping with the comprehensive immigration reforms our country needs."
The law is intended to curb Arizona's role as the busiest illegal gateway into the country. The Pew Hispanic Center estimates that illegal immigrants account for one in 10 workers in the Arizona economy.
Under the law, any business that is found to have knowingly hired an illegal worker is subject to sanctions ranging from probation to a 10-day suspension of its business licenses. A second violation would bring permanent revocation of the license.
The plaintiffs in the lawsuit had argued the law was an unconstitutional attempt by the state to regulate immigration, which is the responsibility of the federal government. The judge's ruling did not address that argument.
"He didn't uphold the law," Pace said. "He didn't decide if it was constitutional. We can have that argument another day."
Attorneys for the state say the groups weren't reading the law correctly and that it does not conflict with federal law.

I am not interested in reading PDF documents showing how Liar Kyl added amendements to solve the ' loopholes' and 'problems' in his own bill which he drafted with Ted Kennedy.
I and the majority of American 'CITIZENS' do not want to grant Amnersty to Illegal Aliens. You need to understand that. You see, even if Liar Kyl put in an amendement to fix a loophole that would for example give violent illegal criminals a 'path to citizenship' we would still be against the bill. I am not against part of the bill, but the whole bill. No Amnesty for Nobody. Get it?
Anyways, Kyl has a history of lying --so if he says he's going to fix a 'loophole' with an amendement who's to believe him? Maybe he's got another loophole to get rid of the amendment that was to fix the other the loophole. He said 'No Amnesty' last year before the election. But of course, Liar Kyl conceived of a loophole to get around that statement. Heh heh heh. With Jon Kyl we are living in the world of Joseph Heller's Catch-22.

Jon Kyl promised in his campaign that there would be no amnesty for law breakers. When he was re-elected he co- sponsored an Amnesty Bill for illegals. Jon Kyl and his new boss Ted Kennedy mocked patriot Americans that demanded the U.S. government enforce current law and demand the border sealed. They would say things like "well, we can't round up 12-20 million illegals and deport them, that would be impossible, therefore we must give them citizenship"
The truth is, most pro-law and order Americans never advocated a massive round up(although if the U.S. wanted to do it, they could accomplish it, it would certainly be easier then bringing 'democracy' to Iraq). Amyway, all the American people wanted was to enforce current immigration law-such as--
Fine employers who hire illegals---Hiring illegals is Illegal.
Many, myself included said if this is done, along with denying illegals entitlements, illegals will deport themselves. I knew this, You Know this, but Liar Kyl and many of the other spinless worms in the Republican Party liked to pretend they didn't know this--They thought you were suckers--Kyl and his ilk look down on you---They wanted to slander you as mean and heartless--while they sold out their souls and our country to bussiness interests and LaRaza--knowing all along that this problem could be solved easily--
Meanwhile, Arizona Republicans with character like Russsel Pearce(Mesa) who passed the new employer-sanctions law, remained true to the will of the citizens.(only vote for Republicans who have already proven themselves).
And cheers to Governor Janet Napolitano(Democrat) who signed the bill into law. The Democratic governor also voiced support for some sort of Amnesty for illegals. But unlike Liar Kyl, when she realized the majority of Arizonians wanted something done about illegals she followed the will of the people. Napolitano secured her re-election. Next election, when the Republican opponent runs against her and declares how he/she will be tough on securing our border, remember Jon Kyl. Lying Republican Jon Kyl.

Liar Jon Kyl would have given this man Amnesty
Senator Jon Kyl ran for reelection on a platform of No Amnesty/No path to citizenship for illegal aliens. He Lied. Liar Kyl.
If Liar Kyl had his way, and his Amnesty bill was passed this man would have been eligible for Amnesty.
This is no exageration-- Jose Carranza(top right) whom was free on bail for previous crimes, including charged with raping a five year old girl, could have still received American citizenship if the Liar Kyl/Kennedy Bill was passed. Just take a look at what Senator Jeff Sessions(AL) called loophole #6 of the Liar Kyl bill, -
Loophole 6 – Some Child Molesters Are Still Eligible:
Some aggravated felons – those who have sexually abused a minor – are eligible for amnesty. A child molester who committed the crime before the bill is enacted is not barred from getting amnesty if their conviction document omitted the age of the victim. The bill corrects this loophole for future child molesters, but does not close the loophole for current or past convictions. [See p. 47: 30-33, & p. 48: 1-2]

Loophole 5 – Completion of Background Checks Not Required For Probationary Legal Status:

No legal status should be given to any illegal alien until all appropriate background checks are complete. [See pp. 290].

Liar Kyl has a history of lying--He ran for re-election on a No Amnesty/No path to citizenship platform. When he was elected he introduced a bill with Ted Kennedy that would give Amnesty to 12-20 million illegals, plus allow them to bring in their family members from Mexico AND then allow 600,000 more residents of Mexico to move to the USA every year to become 'temporary workers'.
KYl then lied again, saying the bill was not Amnesty, since the illegals would have to 'pay a fine'.
He now says, I got a new bill, this time trust me--it is an 'enforcement' bill.

On a Great day For Americans, Jon Kyl Remains A Liar and a Looser

It was a risky political move few could survive.
Sen. Jon Kyl, a conservative Republican re-elected last November on his tough talk about border security(He Lied), placed himself at the center of the Senate battle for comprehensive immigration reform.
Kyl says he thinks Congress can still take action before the 2008 presidential election creates political paralysis in Washington, but it won't be easy.
KYL admits he is not a Conservative, -rather he only pretends to be during re-election campaigns-
"Criticisms of the bill from conservatives "eliminated the ability to get enough votes on the Republican side," he said."
Let's continue to keep an eye on Liar and Looser Kyl. For now let us celebrate that Liar Kyl and the other ant-law and order(anti-secure our border, and reward law breakers) of the Senate were defeated. I will posting who sided with Liar Kyl and Kennedy in the next couple days.

This ghastly closure vote in the Senate on Tuesday, June 26th, should frighten all thinking Americans about the likely course of events if S1639 should wind up the law of the land. What is happening to the United States of American under the leadership of the Sellout Senate, the White House and its likely mirror image of support in the Open Border Democratic House of Representatives should spark immediate anger and action from all Americans.
We speculated before this closure vote in a June 25th piece that enactment of S1639 would be like putting a Trojan Horse into America, allowing the swift almost silent amalgamation of Mexico, the US and Canada into the North American Union.
All these steps remind us that our Federal Government has consistently for years failed its citizens to address the immigration invasion which now allows largely illegal Latin American workers in America to send billions of dollars home, mainly to Mexico, and the 12 to 20 million illegals in our country to make increasing use of our tax supported services. We are screaming and the elites in Congress are scheming.
Very scary, generating a feeling among those aware of what is happening of desperation, of frustration, of the need to do something revolutionary to catch the attention of those who should have repaired our immigration system making our borders secure and demanding that employers not employ illegal aliens or import H1-B's well beyond any need for them. Has the greed and fecklessness gotten too high to reclaim of heritage? How rich does one have to get before he or she begins to think of the country instead of piling up more money?
Well this is not new business. On October 19, 2003, an immigration-overpopulation conference, which I attended, was held in Washington, DC, filled to capacity by many of American's finest minds and leaders. Here is what he said, as written up by Frosty Wooldridge:
A brilliant college professor named Victor Davis Hanson talked about his latest book, "Mexifornia," explaining how immigration—both legal and illegal—was destroying the entire state of California. He said it would march across the country until it destroyed all vestiges of The American Dream.
Moments later, former Colorado Governor Richard D. Lamm stood up and gave a stunning speech on how to destroy America. The audience sat spellbound as he described eight methods for the destruction of the United States.
He said, "If you believe that America is too smug, too self-satisfied, too rich, then let's destroy America. It is not that hard to do. No nation in history has survived the ravages of time. Arnold Toynbee observed that all great civilizations rise and fall and that 'An autopsy of history would show that all great nations commit suicide.'"
"Here is how they do it," Lamm said:
"Turn America into a bilingual or multi-lingual and bi-cultural country. History shows that no nation can survive the tension, conflict, and antagonism of two or more competing languages and cultures. It is a blessing for an individual to be bilingual; however, it is a curse for a society to be bilingual.
"The historical scholar Seymour Lipset put it this way: 'The histories of bilingual and bi-cultural societies that do not assimilate are histories of turmoil, tension, and tragedy.' Canada, Belgium, Malyasia, Lebanon all face crises of national existence in which minorities press for autonomy, if not independence. Pakistan and Cyprus have divided. Nigeria suppressed an ethnic rebellion. France faces difficulties with Basques, Bretons, and Corsicans."
Lamm went on:
"Invent 'multi-culturalism' and encourage immigrants to maintain their culture. I would make it an article of belief that all cultures are equal. That there are no cultural differences. I would make it an article of faith that the Black and Hispanic dropout rates are due to prejudice and discrimination by the majority. Every other explanation is out of bounds.
"We could make the United States an 'Hispanic Quebec' without much effort. The key is to celebrate diversity rather than unity. As Benjamin Schwarz said in the Atlantic Monthly recently: 'The apparent success of our own multi-ethnic and multi-cultural experiment might have been achieved not by tolerance but by hegemony. Without the dominance that once dictated, however ethnocentrically, what it meant to be an American, we are left with only tolerance and pluralism to hold us together.'" Lamm said, "I would encourage all immigrants to keep their own language and culture. I would replace the melting pot metaphor with the salad bowl metaphor. It is important to ensure that we have various cultural sub-groups living in America reinforcing their differences rather than as Americans, emphasizing their similarities."
"Fourth, I would make our fastest growing demographic group the least educated. I would add a second underclass, unassimilated, undereducated, and antagonistic to our population. I would have this second underclass have a 50% dropout rate from high school."
"My fifth point for destroying America would be to get big foundations and business to give these efforts lots of money. I would invest in ethnic identity, and I would establish the cult of 'Victimology.' I would get all minorities to think their lack of success was the fault of the majority. I would start a grievance industry blaming all minority failure on the majority population."

While President Bush and US Senators continue to fiddle with their open borders amnesty policy, also known as the
"Immigration Reform" bill, the US military is warning its personnel and civilian employees not to enter Mexican border towns. Chillingly, this warning also includes US towns located along our southern border.
Towns on the Mexican side of the border, and perhaps those on the US side as well, are increasingly being controlled by Mexican drug lords and their cartels. These same drug lords have placed death-bounties on both our US border patrol agents and US military personnel.
Unconscionably, our leftist mainstream media is neither reporting this nor the facts that open warfare is occurring, on a daily basis, along large portions of the US-Mexico border. Mexican illegals are, on a regular basis, burning down portions of the ecologically-sensitive Coronado National Forest to create diversions; so that drug dealers and other illegals can cross unfettered into the United States. Where is the outrage from the supposed environmentalists? It's nonexistent. Are the arsonists accepted because they're assumed to be from the politically-correct race-no matter what they do? Apparently so.
Note: Despite the arson and increasing warfare at our southern border, our politicians are still working to bypass the American people and pass their Illegal Alien Amnesty bill. What are they thinking-or better yet, smoking?
With the exception of our elite political and business leaders, the Senate Amnesty Bill will-ultimately-help no one. As illegal-turned-legal workers enter the US, in even greater numbers, wages for US citizens will be driven down, members of the US middle class will become fewer and fewer and a new and permanent lower-class structure will have been firmly established upon our shores. Can the Patron-peon scenario be far behind?
After our Congress and President have imbued the current illegals in our country with legal status, said illegals-now-legal will demand somewhat higher wages. Business will then need even more impoverished workers to fill the lower-lower class worker pool. So, illegal entry will continue-aided and abetted by our politicians. It is a never ending cycle of the intentional planned destruction of the United States of America-by those who are sworn to protect it-for the promises of power and larger bank accounts; or additional holdings in the Caymans. Power and money corrupt and there are always those in line begging to be corrupted. We now hear them on and in the media virtually every day.
The current Amnesty Bill also calls for the construction of 370 miles of border fence. HUH??? The Secure Fence Act of 2006, which was passed and funded by Congress, already provides for the building of 700 miles of security fencing along our southern border! Congress is-yet again-ignoring a law that is currently in place in order to attempt to pass a more feckless one. Here is Mr. Kyl attacking the concept that he and his fellow Senators (including his Arizona seat mate, presidential candidate John McCain) actually support an amnesty bill. The question really should be, is this amendment good or not good for the legitimate interests of the Nation? No one small group of people have a right to meet in secret with special interest groups and write an immigration bill and ram it down the throat of this Senate.
I oppose it. It is not right. You can agree or disagree on these amendments, but do so on the merits, whether or not it actually makes sense, not on some deal made by some advocacy group or some business interest. That is not what this Senate is all about.
I hope today the people will begin to see that a small group of Senators who meet in secret and plot out a bill, that if printed in actual bill language would be 1,000 pages, don't have the power to say we can't have amendments and we can't change it, and if you do get an amendment up, we are all going to stick together and vote it down because it doesn't comply with our little compromise.
The masters of the universe are playing a tough game here. I have called them that affectionately. I respect the Members who have attempted to do what maybe they thought was right. But when you look at the bill, it is a product of a political compromise. A group of politicians met in secret and wrote a bill that is exceedingly technical, exceedingly important.

Considering that all those "rioting French" are the citizen children of France's imported guest-workers, it appears that Senator McCain is making a better argument against this bill than he is for it. There is no language in the bill that speaks to the concept of "assimilation," but there is the weasel-speak concept of "integration." This, of course, will be carried out via grants to ethnic interest groups.

The treatment of the Tennessee beauty queen was nothing personal. It had more to do with Mexico's sometimes tense relationship with its powerful northern neighbor.
U.S. athletes have sparked a similar response. In 2005, when the U.S. played Mexico during a World Cup soccer qualifier, the crowd booed the U.S. national anthem and a smattering of fans chanted "Osama! Osama!" during the game.
Smith was booed repeatedly during her stay in Mexico, including last week, when she carried a guitar and wore an Elvis-style suit during a parade of national costumes held in downtown Mexico City.

A 27-year-old day laborer admitted in court Thursday to abducting and sexually assaulting his 7-year-old neighbor at a Southside apartment complex.
"I know what I did," said Jonathan Castillo, speaking through a Spanish translator in Marion Superior Court. "I was drunk, and I can't just fix things just because I'm drunk."
The victim underwent surgery after the attack early Tuesday and remained in Riley Hospital for Children on Thursday, Indianapolis Metropolitan Police Sgt. Matthew Mount said.
Prosecutors asked that Castillo's bond be increased to $250,000, citing the risk to the community and a flight risk because Castillo is an illegal immigrant. Castillo had told Rubick he is a dual citizen of Mexico and Honduras and works as a day laborer.
Castillo also has prior convictions for two felonies -- theft and residential entry -- as well as driving while intoxicated and domestic battery, records show..."

Liar Kyl's office Swamped with calls, lectures constituants on ethics
Jon Kyl said his office has been swamped with angry, sometimes vitriolic, reaction. He estimated that sentiment is running "10 to 1" against the Senate legislation.
"At the fringe, there are some folks who should remember what their mother told them on how to act," Kyl said during a meeting Friday with the editorial board of The Arizona Republic.
Good one, Liar Jon--Didn't your mother tell you not to lie.
People get mad at liars and hypocrites, Jon. Remember Jesus' harsh language directed at the Pharisees? Angry? Yes. Vitriolic reaction? Absolutlely. How about Thomas Jefferson angry harsh 'vitriolic' words towards that 'King' George, a man who also wanted to usurp the will of the people.

Liar Kyl admits that the calls to his office are running 10 to 1 against his amnesty bill. But what is liar Kyl's reaction? Not that "my constituants have spoken, 90% are against this bill, therefore because I am a servant and representitive of the people of Arizona, I will no longer move forward with this legislation". No, instead Liar Kyl wants to give us a lecture on etiquette. While he continues to lie.....
Take his website, as an example, earlier last week I pointed out that Kyl's website had a post which read: “Securing the borders of the United States to protect against the entry of terrorists, drug smugglers, and illegal aliens – while keeping them open for legitimate visitors and commerce – is one of my highest priorities.” Oh really?
Someone brought it to my attention that liar Kyl took this quote off his site, a couple of days after I put a link to it.
Now why would he do that?
Because Liar Kyl has changed his position from 'Securing the borders' from 'illegal aliens' as being one of his 'highest priorities' to giving illegal aliens, those that broke our laws, a path to citizenship, if they pay a small fine, and have the 'proper' ie- fake 'identity' documents. Plus lot's of empty promises about securing the border. Why should we believe a liar?
Meanwhile, Kyl goes on promoting the war in Iraq, in order to bring 'democracy' to Iraq, while he sits in Arizona, thinking up more double-talk, and going against the will of the people(democracy) at home.
